Attached is the letter (click to enlarge) sent from the Twp of Fort Gratiot to General Growth Properties dated May 7th 2008 that was the genesis of this debacle we are now living. In reviewing this letter it raises a number of disturbing questions: 1. First and foremost, why was this not run by the Zoning Board first?
2. How can you separate the activities of Racing and Training? Both involve the same operations of a motor cycle thus the same noise and release of exhaust. Also the special land use for a Motor Sport activity as well as the Fire Code not call out a difference.
3. They state they are concerned about ventilation, and yet request or require no up front engineering studies and we have the situation with the 3 children?
4. They [the Twp] say that will "strictly" enforce the noise ordinance, yet they only wrote one ticket? Also the Twp Attorney in a public meeting told the Twp, to ticket, ticket and ticket again however "one" person has decided "not" to do that? How can that be? Also the board seemed to not know this person had done this? Who is running the ship?
5. It also says that Carl McCulloch made the request and yet the response went to General Properties? Why?
6. Note the references to the surrounding zoning including R-1A (residential), now it doesn't take a rocket scientist to figure out your going to have an issue with a Motorcycle track next to a residential area (there is a Sr's Complex across the street!).
There are clearly too many unanswered questions here! Someone needs to get to the bottom of this mess!
